Tennessee's laws for parental relocation

Moves for Knoxville, Tennessee, residents are never easy, particularly for those who have children. A person has to notify a lot of people about their change of address and do the necessary legal and clerical legwork to switch utilities, licenses and the like.

For single parents with children, it is very important not to forget in the midst of their planning a move to let the parent know about the move. Under Tennessee law, the parent who wants to move has to give 60 days' notice to the other parent of their intention to do so. Shorter moves, those under 50 miles, are an exception to this rule.

The other parent will have 30 days after getting the required notice to object to the move. If a parent makes a timely objection, the parents' custody arrangement determines how the court will handle an objection. If the parents roughly share time with their children, then the judge will not give either the parent who wants to move or the parent who is staying behind any favoritism when making a decision.

On the other hand, if the parent wanting to move has the children the bulk of the time, then the parent who opposes the move will have to show that the move will hurt the child or is a scheme to deprive the other parent of parenting time. Even so, the judge still has to decide whether the move is in the child's best interest.
